What the law expects when you ship alcohol

Age limits differ by country. The common thread is that a tick-box is not a check.

Germany (JuSchG § 9)

Beer, wine and sparkling wine may not be given to anyone under 16; spirits and spirit-based mixes not under 18. The Bochum regional court (23 Jan 2019, 13 O 1/19) held that online shops must check age reliably at order and at handover. Fines reach 50,000 euros under § 28 JuSchG.

§ 9 JuSchG

United Kingdom (Licensing Act 2003)

Selling alcohol to an under-18 is an offence under s. 146, delivering it under s. 151. Both carry a due-diligence defence if you took all reasonable steps, which is why Challenge 25 and an age check on delivery are standard practice.

Licensing Act 2003 s. 146

United States (state law)

The minimum age is 21 nationwide, while shipping rules, carrier requirements and penalties are set state by state. Carriers typically require an adult signature for alcohol deliveries, and alcohol is not mailable through USPS.

18 U.S.C. § 1716(f)

Austria and Switzerland

Youth protection in Austria is state law with a general limit of 16 for beer and wine and 18 for spirits. In Switzerland the federal limits are 16 for beer and wine and 18 for spirits, with cantonal rules on top.

Alcohol age verification FAQ

Short answers for shops shipping beer, wine and spirits.

Is a tick-box age gate enough for selling alcohol online?

No. A self-declaration cannot show that you took reasonable steps. Courts and regulators expect a reliable check at order and a handover that keeps the goods away from minors.

Can I set different ages for beer and spirits?

Yes. In WooCommerce the minimum age is set per product; in Shopify you define rules per product or collection. Beer and wine can trigger a 16 check while spirits trigger 18.

How long does the check take?

A full verification with ID scan, face match and liveness usually takes under 20 seconds. The optional Face ID step takes under 5 seconds and only falls back to an ID check when the estimate is not clear-cut.

What happens to orders that are not verified?

They stay on hold. Customers receive reminders, and after a deadline you choose the order can be cancelled automatically. Unclear results are re-checked by a human before anything is refused.

Does the shop see the customer's ID?

No. The shop receives only the verification status. ID images, selfies and biometric raw data are deleted after 30 days at the latest.
